PAccount Field Terms of Use

Terms governing access to and use of the platform.

1. Acceptance and authorized users

These Terms form an agreement between PAccount LLC, a Massachusetts limited liability company, and the customer company and its authorized users. By accessing PAccount Field, using an assigned account, or purchasing a subscription, the customer and user accept these Terms. Each account is personal and may not be shared.

2. Service

PAccount Field is a business software service for recording field time, activities, projects, cities, breaks, approvals, audit history, reports, and payroll-preparation exports. It is not a bank, payroll processor, tax-filing service, or substitute for ADP or another payroll provider. The customer must review and approve all information before paying wages, filing taxes, or importing an export. ADP and other third-party names and marks belong to their respective owners; PAccount Field is an independent product and is not sponsored or endorsed by those providers.

3. Customer responsibilities

The customer must provide accurate information, maintain authorized users and employee records, obtain required workforce notices and permissions, protect devices and credentials, review synchronization status, retain final payroll records, and comply with applicable labor, payroll, tax, privacy, and record-retention laws.

4. Accuracy and offline use

Users must record truthful and timely information and confirm the selected employees, date, project, city, activity, and synchronization status. Offline actions may remain temporarily on the device until connectivity returns. Users must keep automatic date and time enabled and must not clear browser data, uninstall the application, or sign out while actions are pending.

5. Security and prohibited conduct

Users must use unique passwords, secure their devices, and promptly report lost devices, compromised credentials, or unauthorized activity. Users may not falsify records, access another company's data, share accounts, bypass security, introduce malicious code, perform unauthorized testing, automate abusive requests, reverse engineer, copy, resell, sublicense, or use the service unlawfully.

6. Fees and recurring subscription

The subscription is $37 USD per week plus $2 USD per active Labor employee per week. Administrators and foremen are not included in the employee charge. The customer authorizes PAccount LLC and Stripe to charge the payment method on file automatically each week until cancellation. Applicable taxes may be added. The price, frequency, employee quantity, and total are displayed in Stripe Checkout before purchase.

7. Cancellation, refunds, and failed payments

There is no annual commitment. A company administrator may cancel future renewals at any time through the Stripe billing portal available inside PAccount Field or by emailing erika@paccountpro.com. Cancellation is effective at the end of the paid billing period unless otherwise shown in the portal. Charges already processed are nonrefundable except where required by law. 8. Data, privacy, and providers

The customer retains its rights in customer data. PAccount LLC processes information to provide, secure, maintain, support, and improve the service and to meet legal obligations. PAccount Field uses service providers including Supabase for authentication and database infrastructure, Stripe for billing, and hosting, security, and email providers. PAccount LLC does not store full card numbers, CVV codes, or full bank account numbers. See the Privacy Policy.

9. Ownership and license

PAccount LLC owns PAccount Field, including its design, code, documentation, marks, and improvements. While the customer account is authorized, active, and paid, PAccount LLC grants the customer a limited, nonexclusive, nontransferable, revocable license for its internal business use.

10. Availability and liability

PAccount LLC will provide the service with commercially reasonable care, but uninterrupted availability, synchronization, or compatibility with every external provider is not guaranteed. To the maximum extent permitted by law, PAccount LLC is not responsible for inaccurate customer-entered data, payroll decisions made without customer review, compromised customer credentials, connectivity loss, third-party failures, or indirect, special, or consequential damages. PAccount LLC's total liability relating to the service will not exceed the fees paid by the customer during the three months preceding the event giving rise to the claim.

11. Suspension and termination

PAccount LLC may suspend or terminate access for nonpayment, unlawful or prohibited use, security risk, fraud, abuse, or material breach. When reasonably possible, PAccount LLC will provide notice and an opportunity to correct the issue.

12. Changes, governing law, and contact

Material changes to these Terms will receive reasonable notice through the service or by email. These Terms are governed by Massachusetts law. The parties will first attempt in good faith to resolve disputes, and state or federal courts located in Worcester County, Massachusetts, will have jurisdiction.
